A South Carolina judge upheld his $327 million civil penalty against Johnson & Johnson. A jury in March found J&J overstated the safety and effectiveness of its former blockbuster antipsychotic drug, Risperdal.
J&J says the decision paves the way for it to appeal, and that it marketed the drug responsibly.
Dozens of pending state and federal cases accuse J&J of illegal marketing practices for Risperdal, including paying kickbacks and promoting it for unapproved uses. In one set for trial on Jan. 9, Texas is seeking more than $1 billion.
