A company that built cleanrooms for a pharmacy that compounded tainted steroids, leading to a multi-state breakout of fatal meningitis, says it cannot be held responsible for the people killed or seriously injured from those steroids.
Liberty Industries Inc. built three cleanrooms for Massachusetts-based New England Compounding Center between 2005 and 2008, and says that the cleanrooms were in compliance with ISO standards when constructed. But during a site visit in July 2014 it became clear that the condition of the facility was no longer the condition it had been in when Liberty constructed the cleanrooms, including with holes in the roof, dead insects and a dead bird inside one of the cleanrooms, and air grilles blocked, according to the defendant.
